Terms & Conditions

The Miqo Terms & Conditions were updated on the 16th of October, 2022.

Please take a moment to read through before your purchase. If you have any questions feel free to contact us.


Please note in this document 'Miqo' refers to Miqo Innovations LTD, UK registered company number 12347739, its employees and any subsidiary companies.
'You' refers to the purchasing or communicating party.
The Miqo Terms and Conditions apply to all transactions. These include transactions:
- Made through the Miqo website;
- Made through a third-party marketplace;
- Combined with a transaction including a third party;
- Made by a third party on behalf of an individual.

Conditions of sale

Miqo reserves the right to make any such modification, at any time, to the following attributes:
- Product specifications may change without any prior notice given;
- Product prices may change without any prior notice given;
- Shipping duration; shipping costs; shipping carriers, may change without any prior notice given;
- Product stock level may change without any prior notice given;
- Product availability on a certain marketplace may change without any prior notice given;
- Products may be discontinued without any prior notice given;
- A transaction may be declined without any prior notice given;
- We may opt to cancel a transaction due to loss prevention concerns;

In the case of a change of contract after the sale, the customer will have the choice:
- Accept the new contract;
- Cancel the transaction for a refund.

Payment

Payment must be made in full and prior to the product/service being delivered.
Our payment partners may operate loss prevention policies. Payments can be declined for loss-prevention reasons.

There can be up to a 14-day delay for us to receive your payment. The product may be held during this delay.
There can be up to a 14-day delay for you to receive a refund after we have approved it.

Miqo is not responsible for any charges or fees related to:
- Banks;
- Credit Cards;
- Debit Cards;
- Prepaid Cards;
- Cheques;
- Cash;

Miqo is not responsible for any fees incurred from any money-processing organisation.
Miqo reserves the right to reject any payment.

Shipping

Miqo reserves the right to modify at any time and without prior notice:
- Shipping costs;
- Shipping delivery times;
- Shipping carriers;
- Shipping methods;
- Product packaging.

Miqo is not responsible for any costs, delays or damages relating to:
- The incorrect delivery address being provided by the customer;
- The incorrect return address being used on returned good;
- The customer not being available at the address for delivery;
- The goods being seized; tampered with; destroyed; stolen; disposed of, by any person at the delivery address.
- The goods being seized; tampered with; destroyed; stolen; disposed of, by any person if the goods are rerouted to an alternate address provided by the customer.

For deliveries outside of the United Kindom, Miqo is not responsible for any costs relating to importing goods into a country. Goods imported into a country may be subject to:
- Customs charges;
- Import duties;
- Value-added tax;
- Handling fees.
Shipments will be declared at product retail value.
Miqo is not responsible for any costs, delays or damages relating to importing goods.

Any delivery dates listed are not guarantees. Actual delivery dates may vary.
Miqo is not responsible for any damages caused by a delayed delivery.
Any items that are not delivered by the latest permissible date (see below) will be subject to an investigation of 14 days.
Latest permissible date, after which package will be treated as lost:
- Standard shipping to the UK: 14 days after dispatch.
- Express shipping to the UK: 7 days after dispatch.
- Economy (may be listed as standard) shipping to locations outside of the UK: 10 weeks after dispatch.
- Standard (may be listed as express) shipping to locations outside of the UK: 21 days after dispatch.

Preorders will provide an estimated dispatch date. The goods should usually be dispatched within 3 working days of the estimated dispatch date. If Miqo cannot dispatch within this timeframe a refund will be offered.
Miqo is not responsible for any damages caused by a delayed preorder dispatch date or refunded preorders.

Returns

For undamaged items delivered to the UK within 14 days of the delivery date:
Product cost and shipping cost will be returned. For products bought with discount, only the invoice price will be returned.
The return shipping cost will not be covered. The buyer is responsible for the condition in which the product arrives back to us.
All delivered parts must be included in the return.

For faulty items delivered to the UK within 28 days of the delivery date:
We will offer a replacement new item or a refund. Product cost and shipping cost will be returned. For products bought with discount, only the invoice price will be returned. Our recommended shipping method cost will be returned. The buyer is responsible for the condition in which the product arrives back to us.
All delivered parts must be included in the return.

For faulty items delivered to the UK after 28 days of the delivery date:
Within 1 year after the delivery date, we will offer to repair the item. This does not cover accidental damage, cosmetic damage, general wear and tear, disposable parts of the product, or batteries. Our recommended shipping method cost will be returned. The buyer is responsible for the condition in which the product arrives back to us.

For customer-damaged items delivered to the UK:
Please contact us so that we can discuss repair or exchange options.

For unopened items delivered outside of the UK within 14 days of the delivery date:
Product cost and shipping cost will be returned. For products bought with discount, only the invoice price will be returned.
The return shipping cost; customs fees; VAT; import duties; import taxes; handling fees, will not be covered. The buyer is responsible for the condition in which the product arrives back to us.
All delivered parts must be included in the return. Opened items will not be eligible for a return.

For faulty items delivered outside of the UK within 28 days of the delivery date:
We will offer a replacement new item or a refund. Product cost and shipping cost will be returned. For products bought with discount, only the invoice price will be returned. Our recommended shipping method cost will be returned. The buyer is responsible for the condition in which the product arrives back to us.
All delivered parts must be included in the return.

For faulty items delivered outside of the UK after 28 days of the delivery date:

Customised products are subject to different returns terms. Please see below.

Loyalty Program

The loyalty program is only applicable on campaigns launched through Kickstarter by Miqo or Josef T-D: 'https://www.kickstarter.com/projects/joseftd/'
The loyalty pledge will only be valid if it is for the campaign main product. For example if the project title is 'RevoRoulette - Party shot-pouring robot' then the pledge level must include 'RevoRoulette' as a reward.
The pledge payment must be received. The payment must be on-time, within 10 days of the campaign end date.
Campaign pledges valid for the loyalty program are only able to be made during the campaign period.
The email address of the associated Kickstarter account is tracked. This email will be used to determine loyalty status. The same person using different email accounts to support different products must contact us and we will honor the loyalty program at our discretion.
Miqo retains the right to withdraw the loyalty program at any time without prior notice.
The loyalty program free gift may only be sent at the same time and in the same package as the kickstarter reward.
The free gift cannot be exchanged for any monetary value.
The free gift value and type will be determined at the discretion of Miqo and may be subject to change.
To receive a free gift the customer must have pledged on the current campaign and on the previous campaign. The previous campaign must be the calendar previously launched and funded campaign. If the calendar preceeding Miqo Kickstarter campaign was not pledged and paid the customer will not be entitled to a free gift.
If the Miqo Kickstarter campaign is not successful, it does not meet the funding goal, the customer will not be charged and will not receive a free gift. If the previous campaign was unsuccessful this will not count towards the loyalty program. Only subsequent successful campaign that have charged the customer will be valid.
Pledging multiple subsequent campaigns will not entitle the customer to multiple free gifts per campaign.
The free gift will be delivered at the same time as the product within 12 weeks of the product dispatch date. The free gift may be received up to 9 months from the campaign ending date.

Customised Products

Miqo may at any time: reject; discontinue; modify; make for sale, any customised products.
By creating a customised product the customer is herein granting unlimited intellectual property use and indemnifying Miqo of any damages caused by intellectual property usage.

Customised products must adhere to community guidelines unless explicitly stated otherwise.
Customised products must not include; mention; or reference:
- Spam; advertising; links.
- Registered trademarks; unlicensed brand names.
- Bullying; hate speech; violence; harassment; cyberbullying.
- Nudity; sexual content; self-harm.
- Weapons; illegal drugs or related paraphernalia.


Non-faulty customised products cannot be returned. If your product is fault please refer to the terms in the 'Returns' section.

Warranty

Miqo offers a product warranty in addition to your statuatory rights.
Miqo-designed electronic products will benefit from a 2 year warranty.
Non-electronic and product accessories will benefit from a 1 year warranty.
Each product's warranty will be described on the product page: 'bymiqo.com/product/productname'.
Miqo warranty is only applicable on purchases made through the Miqo website: 'www.bymiqo.com'.

Warranty covers non-functioning products that have not been subjected to the following:
Accidental damage; physical damage; cosmetic damage; wear and tear; water damage; fire; flood; earthquake; lightning; neglect; misuse.
Warranty repairs are at the sole discretion of Miqo. You may be provided with a new product, refurbished product, or suitable alternative.
Any data or personalisation stored on your product may be lost.

Warranty claims must be made within 7 days of the fault appearing.
Miqo has 14 days to repair or replace your product excluding shipping time.
The customer will be liable for cost of shipment to the Miqo repair centre located in the United Kingdom.
The customer will be liable for condition in which the product arrives to the Miqo repair centre.

Repairs

Miqo reserves the right to refuse a request for repair.
The final repair price will be quoted when Miqo can inspect the product at the Miqo repair centre. In case of non-repairability Miqo shall only pay 1 way shipping back to you.
You may be provided with a new product or refurbished product.
Any data or personalisation stored on your product may be lost.

Miqo will complete a repair as soon as possible. This may take 28 days or longer depending on parts availability.
The customer will be liable for cost of shipment to and from the Miqo repair centre located in the United Kingdom.
The customer will be liable for condition in which the product arrives to the Miqo repair centre.
Repaired products will receive a new 6 months warranty from the date it is delivered to the customer. Products with existing warranty will either retain their warranty or have 6 months warranty, whichever is longer.

Recycling

Items sent to Miqo for recycling becomes the property of Miqo.
Data will be lost and cannot be reclaimed.
The item cannot be reclaimed.

Online Services

Online services are all computer communications to and from Miqo servers and servers rented by Miqo.
Miqo retains the right to create, modify, or discontinue online services at any time.
Miqo retains the right to ban users and blacklist details at any time.
Miqo operates a content policy that applies to any data transmitted or stored through Miqo online services.
The following content will be blocked at the sole and unlimited discretion of Miqo:
- Spam; advertising; links.
- Registered trademarks; unlicensed brand names.
- Bullying; hate speech; violence; harassment; cyberbullying.
- Nudity; sexual content; self-harm.
- Weapons; illegal drugs or related paraphernalia.
